246 aduan Union Busting diterima, KESUMA pastikan hak pekerja terbela

KUALA LUMPUR, 8 Oktober– Hak kebebasan pekerja menubuhkan serta menyertai kesatuan sekerja akan terus dilindungi terutama dari segi penindasan atau amalan union busting.

Timbalan Menteri Sumber Manusia, Datuk Seri Abdul Rahman Mohamad berkata
sejak tahun 2015 hingga 31 Ogos lepas, sebanyak 246 aduan berkaitan amalan union busting telah diterima oleh Jabatan Perhubungan Perusahaan Malaysia (JPPM).

“Berdasarkan rekod Jabatan Perhubungan Perusahaan Malaysia (JPPN), jumlah aduan berhubung isu Union Basting yang telah diterima pada tahun 2015 sehingga 31 Ogos 2025 adalah sebanyak 246 aduan. Dari jumlah aduan diterima, sebanyak 158 aduan telah berjaya diselesaikan di peringkat JPPN secara runingan damai. Dan 24 aduan masih lagi dalam tindakan Jabatan, manakala 64 aduan telah dirujuk ke Mahkamah Sekutuan Perusahaan untuk pendengaran kes,” katanya di Dewan Rakyat hari ini.

Tambah beliau, bawah Seksyen 8(2) Akta Perhubungan Perusahaan 1967 (Akta 177), Ketua Pengarah JPPM diberi kuasa untuk menjalankan siasatan dan mengambil langkah sewajarnya bagi menyelesaikan aduan berhubung amalan tersebut.

Mengulas kes yang melibatkan syarikat Flextronics Penang dan XSD International Paper, katanya JPPM kini sedang melaksanakan rundingan damai dan inkuiri seperti yang diperuntuk dalam akta berkenaan.

“KESUMA melalui JPPM sentiasa proaktif melaksanakan program pendidikan perusahaan, pemantauan terhadap majikan serta menambah baik dasar sedia ada bagi memperkukuh hubungan perusahaan yang harmoni dan berkeadilan selaras dengan aspirasi Malaysia MADANI,” jelasnya.

Penyataan itu bagi menjawab soalan Ahli Parlimen Bakri, Tan Hong Pin.

Sementara itu, Ahli Parlimen Bakri, turut mencadangkan agar kerajaan mempercepatkan ratifikasi Konvensyen ILO C87 bagi menjamin kebebasan berpersatuan, selain menggunakan peruntukan Seksyen 59 Akta Perhubungan Perusahaan untuk menyiasat majikan yang mengamalkan union busting.

Menjawab cadangan itu, Datuk Seri Abdul Rahman menegaskan bahawa kerajaan memandang serius perkara tersebut dan akan terus mengambil tindakan tegas berdasarkan peruntukan undang-undang yang ada.

“Union busting merupakan kesalahan di bawah Seksyen 4, 5 dan 7 Akta 177, dan mana-mana pihak yang terlibat boleh dilaporkan kepada Ketua Pengarah Perhubungan Perusahaan untuk tindakan lanjut,” tegasnya.

Ahli Parlimen Padang Terap turut mencadangkan supaya statistik aduan dan keputusan siasatan kes union busting disiarkan secara awam di laman web JPPM bagi meningkatkan ketelusan.

Timbalan Menteri itu menjelaskan bahawa laporan tahunan JPPM sudah sedia diterbitkan dan boleh dirujuk oleh orang ramai melalui Kementerian Sumber Manusia.

“Sehingga 2025, 246 aduan dan selesai rundingan damai 158 dan rujukan mahkamah perusahaan masih ada 64 dalam rujukan dan dalam masa yang sama kita tidak ada masalah kerana laporan dibuat setiap tahunan melalui Kementerian Sumber Malaysia di bawah JPPM itu sendiri dan boleh mengambil rujukan tersebut.

“Setiap tahun laporan tahunan disediakan dan data berkaitan jumlah aduan turut direkodkan secara rasmi,” katanya.
